Tarion Appeal process on 2nd year decision letter
 
Has anyone in this forum had any sucess appealing the items on their 2nd year decision letter from Tarion's 2nd year concilation inspection? Thanks.

Success or not is solely determined by the issues. Tarion tries to avoid conciliation by discussing the issues with the homeowners and builders first. For example - Depending on the issue they may simply tell the builder that they will lose the conciliation and strongly encourage them to resolve the issue.

Before anyone can determine your potential success or not you will need to post the issue(s) and/or you can simply look at the second year Tarion form that specifically lists the issues that are covered.

Also, its very difficult to get a Tarion decision overturned in your favour at the LAT. Since it is second year, instead of 30 day or year one, it doesn't make it more difficult. Its all about the specific issue(s).
