Same issue. It sucks.

The builder tried to repair it after 1yr and the "repair" flaked off after 2yrs and I've just learned to look past it as it wasn't worth my time/energy for multiple repairs....

I believe the upgrade is usually listed as approx. 12", meaning it is not an exact measurement. Provided you're not losing 6"+, I believe a small variance is acceptable per building standards.

Do it after-the-fact. You'll save money and have more selection. It will however require a bit of shuffling in the household with a company coming in to measure, remove counter tops, drawers, etc.

Not sure, but the company who installed it should. Typically their sticker is on the inside of the door...I'd give them a call since you could be waiting a while with Tarion.

For reference we paid $2,800 for a 3 ton, 16 seer unit about 4yrs ago with 10yr parts/labour.

Do not buy an A/C from a builder (unless you can't afford to spring $ for it after closing) as your selections are more limited and you'll absolutely pay a lot more.
