Builder or City, who should fix this?

I don't know what's the correct name of this, but please check the photo first.

When I bought this I was told (verbally) by builder that the City of Ottawa will fix it after a year when they do grading. Now the City refuses to fix it, saying it's builder responsibility, on the other hand builder is delaying response and I'm still waiting.

From my understanding if the city did an inspection and accepted things as is, aren't they responsible for it now?

I know I failed myself by not reported in the Tarion 1 year form, but this is tripping hazard and I have 2 kids. I'm tired of waiting for someone to fix it. They charge enough taxes to solve those issues.

According to the very bottom of this link, the builder is responsible for adjusting it since it's a new home build. Plumbing issues can still be reported under the two year Tarion warranty but I'm not sure if this would apply or not.

Thanks Brian, This is very helpful. At least I know whom to bug now. But still, the guy from city came with a hummer on his hand and could just fix it. It's a tripping hazard for my kids.

Such a shame that this simple issue is not being easily resolved. I live in Milton Ontario, in Halton Region, which includes Oakville, Milton, and Burlington. In my case for an issue like this I would call Halton Region who would happily come out and lower this main water shut off valve. As well, this would take one phone call where the phone would be answered and the issue would be noted and passed on.

Exactly, it's so disappointing seeing the guys from city standing with huge hummer and not doing anything. I didn't know how it should be resolved back then. I guess he wanted a tip to resolve the problem. But tip is usually paid after work is done, if I pay before it would be bribe

And Mattamy doesn't respond to my emails for a week. I dropped them few email and there is only silence. They were not like this before.

it's a collapsible nested tube - there's nothing in it. it just protects the valve at the bottom below the frost line. every one of these I've ever seen sticking up too high was easily adjusted just by stepping on it gently. maybe some light stomping.

You might be able to put your entire weight on it and push it down. Place a 2x4 across the top of it and stand/hop on it while using someone’s shoulders for balance.

Who did you contact in the City? Mine was out like this as well and I called 311 and someone from water services came out to lower it. This was in June.

I've opened a ticket by calling 311. So the same. Still no response from Mattamy. Will try to push it myself or maybe put a wood block and hummer it with cabinet hummer.

Email your city councillor, they will escalate your request/complaint to Water Services management.
