Default Grading issue

Looking for some advice here before seeing what I can do.

Our builder finally laid sod just over a month ago. Issue is the grading is incorrect and the builder has confirmed in writting that the grading is incorrect. The result is that we have a trench at the back of our lot where the water has never dried. The grass is now rotten and covered in mold and is breeding mosquitoes like they are going out of style.

We are not at our one year yet but are there any other avenues that we can take? We are worried about the health of our kids and the stench in backyard doesn't allow us to enjoy it. Also worried about any type of infection they could get by going close to this bacteria infested area.

you are referring to the swale, not sure why the water won't dry up, we haven't had any rain for ever....you must be watering the crap out of your yard...anyway try getting a load of topsoil and build up the low areas to direct the water to catch basin. you dont happen to have a garden encroaching on the swale do you?

Yes the swale but the builder has already agreed that there is a grading issue as the water never dries up - never has since they laid the sod - I avoid watering that area - you can see pools of water 7 neighbours down. It was all improperly done

With a written confirmation from the builder confirming there is an issue it, we cannot attempt to fix it ourselves. The builder is trying to say that the soil will settle and that the grading is complete.

Again, my concern is the mosquitoes and the mold back there.

I'd call the city - we had an issue with a Bell box encroaching our property. The builder and Bell were absolutely useless, but the city came out and inspected it and dealt with Bell. The box had no right to be on our property, but with just us complaining, nothing would get done. BTW, it was brought to our attention that it was the builder's responsibility to properly mark where the boxes should be.

Sorry this seems off track - this is a different situation, but a similar principal applies. If they're not living up to their agreement with the city (which I believe grading requirements are) then definitely call 311. They're more worried about the city than you.

Ottawa's by-law inspection department is fantastic.

They have a guy responsible for approal of grading in new areas

Ask to speak to him and ask if he can come and have a look.
