Default Issue with moving company

Out of respect for Greg, I won't post the moving campany's name, but I'm hoping that someone will be able to help me.

I took out insurance for our move within Binbrook, ON. Our items were loaded on to the Mover's truck on September 14th and unloaded on the 25th. I advised the salesman (that gave me my quote) that I was concerned about my Home Theatre equipment and computer equipment. I was advised by him that I should take out insurance to cover damages or loss of the equipment. During the move my projection screen and projector were damaged due to the screen being rubbed against a wall while trying to move it into the basement. The projector has been damaged due to large/heavy boxes being stacked on top of it (even though the box it was in is clearly marked as fragile). I submitted a claim and the moving company is now refusing my claim saying that I needed to have their packers pack my equipment and those types of objects aren't covered by the isurance that I took out anyway. This was never communicated to me and these are the specific items I was getting the insurance for. I'm contacted the Better Business Bureau and they told me that this was out of thier scope. Do I have any other course of action or am I SOL and out $7000 worth of equipment at this time?

I assume that you signed some sort of insurance document? What does it say?

call your home insurance company and your lawyer. you'll probably have to sue and settle for less than replacement cost of the items, but at least you'll get something. if you don't want to pay a lawyer, go through small claims court (it's pretty simple to get started) where they'll have to prove that you're not covered despite selling you insurance.

I agree. Take them to court. If you go thru your own home insurance it could affect your premiums.

They may settle once they know you're not screwing around with them.

Thanks for the advise guys. I contacted the BBB again and they've actually re-opened my case and sent it to the company. They have until November 5th to respond. If this doesn't work, I guess I'll be taking them to small claims.

From my experience the BBB is a waste of time. They forward your complaint to the company, the company responds and the BBB sends you the response. If you don't address the response the BBB closes the case as resolved. Just becomes a bunch of emails back and forth of he said she said.

I used the BBB and it got nowhere. Eventually I went to the company president and got my complaint resolved.
